Fairfax VA agrees to Reduce DUI charge hours before Court Ordered Intoxilyzer Inspection

A client charged in Fairfax County with a DUI was allowed to plead to a reduced charge of Reckless Driving with no license suspension. The accused’s Breath Result was a .14 according to the Fairfax County Intoxilyzer 5000 machine. However Richmond, Virginia DUI Lawyer Bob Battle convinced the Fairfax County General District Court Judge that the use of unknown replacement parts, including a replacement “chopper motor,” merited an inspection of the machine by his expert, Thomas Workman. Just hours before Mr. Workman was set to test the machine, the Fairfax County prosecutor contacted Bob Battle with the plea bargain offer.
